1. Introduction
Welcome to Mossie. These Terms of Service ("Terms") govern your use of the Mossie application and services (the "Service") operated by Mossie ("we," "our," or "us"). Mossie is a workspace for teachers that helps you create lesson plans, assessments, and feedback that sound like you wrote them.
By creating an account or using Mossie, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
2. Account Terms
Eligibility
You must be at least 18 years old to create an account. Mossie is designed for teachers and education professionals. By using the Service, you represent that you meet these requirements.
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
One Account Per Person
Each account is for individual use. You may not share your account credentials or allow others to access your account.
3. Acceptable Use
Permitted Uses
Mossie is designed for:
- Creating lesson plans, assessments, and educational content
- Generating professional feedback and documentation
- Organizing teaching materials and student information
- Other legitimate educational and teaching purposes
Prohibited Uses
You may not use Mossie to:
- Generate harmful, abusive, or inappropriate content
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use the Service for any commercial purpose other than your teaching work
- Resell, redistribute, or sublicense the Service
4. Subscription and Billing
Pricing Tiers
Mossie offers the following tiers:
- Free: Limited features, 10 generations per month
- Premium: $12/month or $79/year, full access to all features
- School: Custom pricing for institutions
Free Tier
All new accounts start on the Free tier, which includes core features with limited AI generations. No credit card is required. You can upgrade to Premium at any time to unlock all features.
Billing
- Subscriptions are billed in advance on a monthly or annual basis
- Prices are in USD and may be subject to applicable taxes
- We use Stripe (web) and RevenueCat (mobile) for payment processing
Renewal and Cancellation
- Subscriptions automatically renew unless cancelled
- You may cancel anytime from your account settings
- Cancellation takes effect at the end of the current billing period
- You retain access to Premium features until your subscription expires
Refund Policy
We offer refunds within 14 days of purchase if you have not significantly used Premium features. Contact support@mossie.education for refund requests.
5. Intellectual Property
Your Content
You retain full ownership of all content you create using Mossie, including lesson plans, assessments, documents, and other materials. We do not claim any intellectual property rights over your content.
License to Use Your Content
By using Mossie, you grant us a limited license to process your content solely for the purpose of providing the Service. This includes storing, displaying, and using your content to generate outputs as you request. We do not use your content to train machine learning models.
Mossie's Intellectual Property
The Mossie service, including its software, design, branding, and documentation, is owned by Mossie and protected by intellectual property laws. You may not copy, modify, or create derivative works from our Service without permission.
6. Generated Content
Teacher Responsibility
All content generated by Mossie is provided as drafts for your review. You are responsible for:
- Reviewing all generated content before use
- Ensuring accuracy and appropriateness for your context
- Making any necessary edits or corrections
- Final decisions about what content to use
Not a Substitute for Professional Judgment
Generated content is a starting point, not a replacement for your professional expertise. Mossie does not make educational decisions. You do.
No Guarantees
We do not guarantee that generated content will be accurate, complete, or suitable for any particular purpose. Always verify important information.
7. Limitation of Liability
Service Provided "As Is"
Mossie is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
Limitation of Damages
To the maximum extent permitted by law, Mossie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill.
Maximum Liability
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
8. Termination
Termination by You
You may delete your account at any time from your account settings. Upon deletion, all your data will be permanently removed within 30 days.
Termination by Us
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in prohibited uses of the Service
- Fail to pay subscription fees when due
We will provide reasonable notice before termination when possible, except in cases of serious violations.
Effect of Termination
Upon termination, your right to use the Service ends immediately. We recommend exporting your documents before terminating your account.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect.
Continued use of Mossie after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and delete your account.
10. Governing Law
These Terms are governed by the laws of South Africa, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of South Africa.
11. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mossie regarding the Service.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
